Surety Bonds Across New Jersey

Surety bonds provide a guarantee that a major investment in a project will be protected, regardless of whether the work is completed. They are particularly common in the construction industry and often required for government contracts.

A surety bond works differently from typical insurance. Here’s a simple example: Suppose a contractor is building a new office for a government agency. The agency needs assurance that taxpayers won’t lose money if the contractor fails to deliver as promised.

To address this, the contractor purchases a surety bond by paying a premium to an insurer. If the contractor doesn’t fulfill their obligations, the insurer compensates the agency. Unlike regular insurance, the insurer will then seek reimbursement from the contractor. This ensures the agency doesn’t have to recover the funds on its own.

Surety bonds are not limited to government contracts; they can be used between any two organizations. The party buying the bond is called the “principal,” while the one receiving the payout is the “obligee.”
